Product and Drug Products Liability
What is product liability?
The concept of product liability means that sellers of a product can be held liable if they were negligent at some point in the product’s manufacturing or marketing, and a defective product caused injury to a consumer.
Common groups of products that can cause significant harm or death to the user include the following:
- Pharmaceutical products (over-the-counter drugs, prescription drugs)
- Medical devices
- Children’s toys
- Electric products
- Automobiles
- Dangerous household products
What does the law say about products liability?
Under Illinois law, an injured person is entitled to compensation for injuries resulting from a defective product if it was in an unreasonably dangerous condition at the time the product left the control of the manufacturer and the unreasonably dangerous condition caused the victim's injury.
There must be specific circumstances present to be able to file a product liability claim. If you have been injured by a defective product, you should contact an experienced product liability lawyer that will be able to examine the details of your accident.
The designer, engineer, manufacturer, component part manufacturer, wholesaler and retailer, or similar parties, are all potentially liable for any injuries the product caused the end user. If a claim results in a monetary settlement or verdict, responsibility may be distributed among the different parties.
Product liability litigation helps keep consumers safe by helping improve or remove dangerous products and substances from the market.
At the Law Offices of Jeffrey J.
